Terms of service

These terms of service (“Terms”) govern your use of the platform provided by techtropy (“we”, “us”, or “our”), including strategy development, document storage, collaboration in organizations and teams, and the business simulations (together the “Service”). By accessing or using the Service, you agree to these Terms. If you use the Service on behalf of a company, university, or other organization, you confirm that you are authorized to accept these Terms for it. If you do not agree, do not use the Service.

This is an unofficial English translation provided for convenience only. The is legally binding.

Use of the service

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not violate any applicable laws or regulations, infringe the rights of others, or submit content that is unlawful or harmful. You must not disrupt or overload the Service, probe or circumvent its security or access controls, access accounts, organizations, simulations, or data that are not yours, or introduce malicious software. You must not access the Service through automated means such as scraping or bulk collection beyond the export features we provide. Reselling the Service or offering it to third parties requires our prior written consent.

Account responsibilities

If you create an account, you must provide accurate information, keep your login credentials secure, and not share your account with others. You are responsible for all activity under your account and must notify us immediately of any unauthorized use. You can delete your account at any time in the account settings. How we handle personal data is described in the privacy notice.

Organizations and teams

Parts of the Service are collaborative. Content you bring into an organization, team, strategy, or simulation, such as documents, decisions, names, and briefings, is visible to the other members of that space and remains available to them even after you leave it. Owners and administrators of an organization manage its members and access, and they are responsible for how their organization uses the Service; we may follow their instructions regarding the organization's content and membership. If you leave an organization or are removed from it, you lose access to its content.

Intellectual property

The Service itself, including its texts, graphics, logos, software, and the design, scenarios, and generated content of the business simulations, is the property of techtropy or its licensors. We grant you a limited, non-exclusive, non-transferable right to use the Service as intended for as long as you have access to it. You may not copy, reproduce, distribute, or modify the Service, or use our trademarks or branding, without our prior consent. Reports and data exports we provide are for use within your organization, including coursework and your own analyses and models.

User content

You keep all rights to the content you submit to the Service, such as uploaded documents, strategy inputs, company names, and messages. You grant us a non-exclusive, worldwide license to host, store, reproduce, adapt, and display this content solely as needed to operate, secure, and improve the Service, including showing it to the people you share it with. The license ends when the content is deleted from the Service, except for backup copies we keep for a limited time. You are responsible for your content: you confirm that you hold the necessary rights to it and that it does not violate any laws or third-party rights. We may remove or block content that violates these Terms or applicable law.

Business simulations

The business simulations are educational tools. All scenarios, markets, companies, prices, forecasts, and reports within a simulation are fictional and generated for learning; any resemblance to real companies, brands, or market data is coincidental. The Service does not provide financial, investment, legal, tax, or other professional advice, and simulation results are no basis for real-world business decisions. Simulation results, standings, and in-simulation values have no monetary value and establish no claims against us. To keep simulations fair, you must not influence a simulation through technical means outside of regular play. We may adjust, reset, or archive simulations and their parameters, for example to preserve the balance and orderly progress of a cohort.

Changes to the service

The Service evolves continuously. We may add, change, or remove features, introduce usage limits, and temporarily interrupt the Service, for example for maintenance. Where a change materially restricts core functions you actively use, we will inform you in an appropriate manner and, where possible, with reasonable advance notice. We are not obligated to retain content indefinitely: when a feature or your access ends, we may delete associated content after a reasonable period.

Termination

You may stop using the Service at any time and delete your account in the account settings. We may suspend or terminate your access with reasonable notice and, for good cause, without notice, for example in the event of a serious or repeated violation of these Terms, legal requirements, or risks to the security or integrity of the Service. Upon termination, your right to use the Service ends. Provisions that by their nature extend beyond termination, such as those on intellectual property, liability, and governing law, continue to apply.

Disclaimers

The Service is provided “as is” and “as available”. We do not guarantee that the Service will be uninterrupted, error-free, or secure, that simulated data, forecasts, or reports are accurate or suitable for any real-world purpose, or that content submitted by other users is lawful or correct. Your statutory rights remain unaffected.

Limitation of liability

We are liable without limitation for intent and gross negligence, for injury to life, body, or health, and under mandatory statutory provisions such as product liability law. In the event of slight negligence, we are liable only for the breach of essential contractual obligations, meaning obligations whose fulfillment makes the proper performance of the contract possible in the first place and on whose fulfillment you may regularly rely. In that case, our liability is limited to the damage that is foreseeable and typical for services of this kind. Any further liability is excluded. Where our liability is excluded or limited, this also applies to the personal liability of our employees and agents.

Governing law

These Terms are governed by the laws of the Federal Republic of Germany. If you use the Service as a consumer, this choice of law does not deprive you of the protection of mandatory provisions of the law of the country in which you reside. If you are a merchant, a legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from these Terms is our seat in Germany.

Severability

Should individual provisions of these Terms be or become invalid, the validity of the remaining provisions remains unaffected. The invalid provision is replaced by the applicable statutory rules.

Changes to terms

We may update these Terms, for example when we introduce new features or when legal requirements change. We will announce material changes in an appropriate manner before they take effect, for example on this page or within the Service, and where the law requires your consent to a change, we will ask for it. If you do not agree with updated Terms, you may stop using the Service at any time and delete your account.
